6/14/08 - The County of San Diego, CA is in the process of amending noise regulations in the unincorporated areas of the county. This ordinance specifically takes AIM at off-road vehicles. The noise limits are unduly biases against OHV users. It is imperative that off-roaders sound off and let their elected representatives know they oppose this draconian ordinance. The text of the section affecting off-road recreational vehicles is as follows.

SEC 36.416 NOISE FROM OFF-ROAD RECREATIONAL VEHICLES.

No person shall operate or allow the operation of an off-road recreational vehicle that produces a noise that at any time exceeds the following maximum sound levels:
65 decibels between the hours of 7 a.m. and 7 p.m and 55 decibels between the hours of 7 p.m and 7 a.m.
The maximum sound level shall be measured at the property line of or on any occupied property. As used in this section occupied property means property on which there is a building for which a certificate of occupancy has been issued.

Dear SDORC,

Just visiting your website and reviewed the letter. Good letter but would suggest that you revise all use of "noise" in the letter to "sound." Noise is a perception. Sound is measurable. Noise is also a subtle negative word - avoid it as much as possible and demand, as much as possible, that the county use "sound" as a measurable unit.

July 30, 2008 - Updated Ordinance Status.

This e-mail is to inform you of the status of the County’s Noise Ordinance Amendment. A Negative Declaration (ND) pursuant to CEQA has been prepared for the noise ordinance amendment and will be out for public review from July 31 to August 30, 2008. The ND and draft ordinance are available for review on the DPLU website. http://sdcounty.ca.gov/dplu/press/POD08009.html
